Why an INAPI search isn't enough
The public search only matches literal text. Trademarks get rejected in the layers only an expert sees.
Phonetic matches
Trademarks that sound the same or very similar (PIXEL vs. PYXEL, BIOMA vs. BIOHMA) block your registration even if you spell them differently.
Graphic elements
If your trademark is a label or mixed, INAPI compares colors, shapes and visual composition. A name search doesn't catch this.
Related classes
A trademark registered in a different Niza class can still block you if the products or services are considered related.
Why searching your trademark before filing at INAPI is not optional
INAPI's public search only finds literal matches: type the exact name of a trademark and it tells you whether it exists. But INAPI rejects an application not only for identical marks, but also for similar marks likely to cause confusion — and the public search doesn't show you those.
Likelihood of confusion is assessed on three levels: phonetic (how it sounds), figurative (how the logo looks) and conceptual (the idea it evokes), within the same Nice class or related classes. For example, a mark like “BIOXXI” can be rejected over a “BIOXI” already registered in the same class, even though they are spelled differently. Filing without that prior search means risking the filing fee — which INAPI does not refund — and several months of processing.
